1. Agreement to Terms

By accessing or using Notify'n ("the Service"), provided by HMD Corp., you agree to be bound by these Terms of Service. If you disagree with any part of the terms, you may not access the Service.

2. Description of Service

Notify'n is an email marketing platform that allows users to create, send, and track email campaigns. The Service includes features such as:

• Bulk email sending capabilities
• Contact management and segmentation
• Email template creation and customization
• Analytics and performance tracking
• Team collaboration features

3. User Accounts

When you create an account with us, you must provide accurate, complete, and current information. You are responsible for safeguarding the password and for all activities that occur under your account.

You agree to notify us immediately of any unauthorized access or use of your account. We reserve the right to suspend or terminate accounts that violate these terms.

4. Acceptable Use Policy

You agree NOT to use the Service to:

• Send unsolicited commercial emails (spam)
• Harvest or collect email addresses without consent
• Send emails containing malware, phishing, or fraudulent content
• Violate any applicable laws or regulations (including CAN-SPAM, GDPR)
• Infringe on intellectual property rights
• Send content that is harmful, threatening, or discriminatory

5. Email Sending Limits

Your email sending limits depend on your subscription plan:

• Free Plan: 1,500 emails per month (500 contacts max)
• Pro Plan: 12,500 emails per month
• Enterprise: 25,000 emails per month

Exceeding these limits may result in temporary suspension until the next billing cycle or upgrade of your plan.

6. Payment Terms

Paid subscriptions are billed in advance on a monthly or annual basis. All fees are non-refundable except as required by law. We reserve the right to modify pricing with 30 days notice.

7. Intellectual Property

The Service and its original content, features, and functionality are owned by HMD Corp. and are protected by international copyright, trademark, and other intellectual property laws.

8. Limitation of Liability

In no event shall HMD Corp., its directors, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.

9. Termination

We may terminate or suspend your account immediately, without prior notice, for any breach of these Terms. Upon termination, your right to use the Service will cease immediately.

10. Changes to Terms

We reserve the right to modify these terms at any time. We will provide notice of significant changes by posting the new Terms on this page and updating the "Last updated" date.
